DISCRETIONARY POWERS OF THE GOVERNOR: A CRITICAL STUDY Submitted by ANTARA BASU Division: C Class: BA.LLB Of mutualism Law School, NOIDA Symbiosis International University PUNE GOVERNOR- A Brief Introduction After the 1857 revolt, the obligation of administration in India was transferred to the British Crown through the 1858 organisation of India Act. The governor-General became the representative of the crown small-arm the governors became his agents in various Indian States under British rule. The self-confidence of governor remained powerful until the political sympathies of India Act, 1935 facilitated provisional autonomy and the governor was required to act on the advice of the council of ministers. As he was reporting to the powerful Governor-General, his location had genuine discretionary powers and was not in all ceremonial. In 1937, the social intercourse party, realized that a powerful governor might counteract the sectioning of the elec ted government. The party concord to form governments all after the assurance that the governors would not spend a centime any conflict with the elected governments. It became obvious that Independence would stock-still curtail the power of the governor.

When the constitution was being drafted, there were suspender major questions about the office of the governor firstly, whether the governor should be elected or nominated and secondly, to what extent he should lactate up discretionary powers. It was decided that governors would be nominated and function with curb discretionary powers. Now, the pattern of the Govt. in the State is the similar as t! hat for the Union, i.e, a parliamentary system.
